Ummupazil Omarova made a report on the activities of the Commissioner for Human Rights in the Republic of Dagestan in 2017. She informed the deputies about the main directions of her work over the past period.

Basically, the activities of the Commissioner were based on requests from citizens, on which measures were taken to resolve controversial situations and legal assistance was provided.
In 2017, the Office of the Commissioner received 1,480 complaints. 627 of them required direct intervention, 120 issues were resolved and clarifications were given to citizens on 854 appeals. 63% of all requests are complaints about violation of social rights. Mostly representatives of vulnerable segments of the population seek help: disabled people, pensioners, orphans, low-income and large families.

The Ombudsman drew attention to the fact that most of the complaints concerned violations of housing rights. Last year, 322 orphans received apartments, but there are more than 2,700 people on the waiting list. There are many complaints from those who receive apartments under the program for relocation from dilapidated housing that houses are being built with defects on the outskirts of the city, while the wishes of citizens are not taken into account.
The number of complaints about violations of building codes, poor quality of utilities and registration in this area doubled during the reporting period.
The number of complaints regarding unlawful treatment and violation of citizens’ rights by law enforcement officers and failure to comply with court decisions remained at the 2016 level.

Then, Deputy Chairman of the People's Assembly Committee on Education, Science, Culture, Youth Affairs, Sports and Tourism Magomed Kurbanov presented the draft law “On Amendments to the Law of the Republic of Dagestan “On Youth Policy in the Republic of Dagestan”. In particular, Article 5 of the law is supplemented by a new clause on the involvement of youth public associations in the discussion of draft regulatory legal acts on the implementation of the legal rights and interests of youth.

The changes made to Article 13 of the law are aimed at involving young people in activities to protect nature and preserve the environment, as well as involving disabled people in physical education and sports.

The draft law “On Amendments to the Strategy for Social and Economic Development of the Republic of Dagestan until 2025, approved by the Law of the Republic of Dagestan dated July 15, 2011 No. 38” was presented by the Acting Deputy Chairman of the Government of the Republic of Dagestan - Minister of Economy and Territorial Development of the Republic of Dagestan Rayudin Yusufov .

The main task of the NPC this year is to officially elect the new Chairman of the People's Republic of China and the Premier of the State Council of China. These posts are expected to remain with the current leaders, Xi Jinping and Li Keqiang.

Changing the Constitution

Another task facing the NPC is changing the Constitution of the People's Republic of China. Only this body has the right to change the fundamental law of the country. Earlier, at the end of February, the Plenum of the CPC Central Committee proposed removing from the Constitution the provision on the maximum term of office of the Chairman of the People's Republic of China (now this post cannot be held for more than two terms in a row). The corresponding vote will take place on March 11.

“There are both objective and subjective reasons here,” explains Grachikov. “This ten-year period was not enough; in the first five years, the manager got used to it, got into the swing of things, started changing something, and then had to leave. Given the old apparatus that he received, he could not implement the changes that he had in mind.”

Therefore, according to the political scientist, any personnel changes in China should be considered comprehensively.

“One cannot think that some narrow group of people close to Xi Jinping are carrying out revolutionary actions. This is an urgent issue arising from the internal life of China,” says the expert.

“Introducing such amendments does not mean at all that the chairman of the state will be able to hold his post for life. The new body will receive exclusive powers, including those related to arrests of officials, investigations and inspections. “This is a logical step in the development of a bureaucratic system that strives for order,” says Vasily Kashin. — The previous system was based on the work of the CPC Central Commission for Discipline Inspection. During the reporting period, the Accounts Chamber carried out 69 control activities, during which budgetary and financial violations were identified for a total amount of 12,221.6 million rubles. 882.5 million rubles of budget funds were reimbursed to budgets of various levels; 209 officials were brought to disciplinary liability, 29 of them were dismissed, other violations were established, among which violations of misuse and ineffective use of budget funds, inflated costs during construction and repair work, and others prevailed, the speaker noted.

The date of the 14th (November) session was set by the Presidium as November 30th. 28 issues have been tentatively included on the agenda.

At the beginning of the meeting, Khizri Shikhsaidov congratulated the Chairman of the Committee on Interethnic Relations, Affairs of Public and Religious Associations Magomedkadi Hasanov on his birthday and presented him with the personalized watch of the Chairman of the People's Assembly.

The session will begin with the traditional parliamentary “warm-up”, at which representatives of the factions will speak. The Speaker of Parliament noted that the issues raised must be relevant and meet the interests of voters. In particular, on the initiative of the parliament, the 2018 budget proposes to provide funds to increase wages for low-paid categories of public sector employees who are not subject to the “May” decrees of the President of the Russian Federation. Among the issues that will be presented for the second reading is the draft law “On Amendments to the Constitution of the Republic of Dagestan,” which, in accordance with changes in federal legislation, spells out additional conditions for terminating the powers of a senior official.

In the first reading, two bills will be adopted, which will introduce changes to the Constitution of Dagestan, relating, in particular, to the approval of a candidate for appointment to the position of prosecutor of the republic with the People's Assembly.

In the second reading, it is expected to adopt the draft laws “On Amendments to Article 3 of the Law of the Republic of Dagestan “On Organizational Property Tax” and on the corporate income tax rate for residents of the territory of rapid socio-economic development “Kaspiysk” and “On Amendments to the Law of the Republic Dagestan “On the budget process and interbudgetary relations in the Republic of Dagestan.”

Regarding the latter, the speaker of the Dagestan parliament pointed out the need to take into account the socio-economic situation of cities and regions when distributing budget funds, making this data publicly available and transparent, and compiling a detailed register of objects that will reflect where the funds will be allocated and in what amount.

The draft law “On perpetuating the memory of outstanding figures, honored persons, as well as historical events and memorable dates in the Republic of Dagestan”, initiated by the Chairman of the People’s Assembly Khizri Shikhsaidov, will be presented for the third reading. The bill determines the procedure for assigning the names of outstanding figures or honored persons to state organizations and objects in state ownership on the basis of a positive conclusion of the Commission on perpetuating the memory of such persons, through a referendum and population gatherings.

The main issue on the agenda of the upcoming session is the draft law “On the republican budget of the Republic of Dagestan for 2018 and for the planning period of 2019 and 2020,” which will be presented for the first reading.

As Committee Chairman Seifulah Isakov noted, there was a wide discussion of budget parameters among the leadership of the People's Assembly, in committees and at public hearings with the participation of deputies, representatives of the Government, the Public Chamber, the expert and scientific community, and heads of republican ministries and departments.

As noted, the budget retains its social orientation. During the discussion, significant reserves for its replenishment were identified.

According to the Accounts Chamber, only by increasing the tax base, the revenue side of the budget can be increased by 229 million rubles.

Khizri Shikhsaidov proposed to redistribute the Government's reserve fund and direct it to the development of industry, which is an important engine of the economy. He once again emphasized that all mechanisms for the distribution of budget funds must be transparent. In addition, the policy of providing government guarantees should be revised. The Dagagrokompleks enterprise was given guarantees for 1 billion 600 million, but it was declared bankrupt and external management was introduced, but no one was punished.

Wishes were also expressed to include in the budget funds to pay off debt to the TFOMS.

In the first reading, deputies will also consider the draft law “On the budget of the Territorial Compulsory Health Insurance Fund of the Republic of Dagestan for 2018 and for the planning period of 2019 and 2020.”

Regarding the draft law “On the procedure for the submission by citizens applying for a municipal position in the Republic of Dagestan, the position of the head of the administration of a municipal formation of the Republic of Dagestan under a contract, and persons filling these positions, information on income, expenses, property and obligations of a property nature and the implementation of an audit reliability and completeness of the specified information”, which will be presented for adoption in the first reading, the speaker of parliament noted that the governance structure of the capital of the republic, with its administrative division into three municipal districts, raises many questions. The total number of employees of city and district administrations is more than a thousand people; almost 350 million rubles are spent on maintaining officials, which raises questions. The cumbersome management structure does not contribute to the effective solution of urban problems. In particular, there is intensive development of park areas, which is clearly visible from Lake Ak-Gel, which is filled with earth and plots for construction are distributed, although there should be a park area there.

He instructed the Committee on Legislation, Legality, State Building and Local Self-Government, with the involvement of the expert community, to review the city’s governance structure and, if necessary, make changes to the relevant law.

Clarifying changes will be made to a number of republican laws related to innovations in federal legislation.

At the session it is expected to adopt the Forecast Plan (program) for the privatization of state property of the Republic of Dagestan for 2018 and the main directions of privatization of state property of the Republic of Dagestan for 2019 and 2020.

18 state-owned objects are proposed for privatization in 2018. Expected income from their sale will amount to 110 million rubles.

The Chairman of Parliament, commenting on the privatization plan, noted that it is necessary to calculate in advance whether it is profitable for the state to sell the designated objects. He expressed doubt about their assessment and instructed the Committee on Budget, Finance and Taxes, together with the Committee on Economy, Investment and Entrepreneurship, to carefully consider the objects included in the plan and take control of their privatization.

The session will also adopt a resolution of the People's Assembly of the Republic of Dagestan “On instructions to the Accounts Chamber of the Republic of Dagestan.” It includes 18 events.

As part of the control powers, the session will also consider the issue of the socio-economic situation in the municipal formation “city of Izberbash” (in terms of compliance and implementation of the laws of the Republic of Dagestan).
